1. About these terms
These terms and conditions, together with our Booking Conditions below and our Privacy Policy, govern the provision of travel services by Eastbound Escapes (a trading name of Times Travel, "we", "us", "our"), a company registered in England and Wales under number [COMPANY NUMBER], with its registered office at [COMPANY ADDRESS]. By making an enquiry or booking with us, you agree to these terms. Nothing in these terms affects your statutory rights as a consumer.
2. Our role
We act as the organiser of the packages we sell and, where relevant, as agent for the suppliers of individual travel components (such as flights or hotel-only bookings). Where we arrange a package that includes a flight, your package is financially protected as described in clause 6.
3. Booking and contract
Bookings are made by telephone or via our enquiry form. A binding contract is formed only when we issue a written booking confirmation to you. The lead name on the booking is responsible for the accuracy of all information provided and for all payments. Please check your confirmation carefully and tell us immediately of any errors.
4. Prices, payments and deposits
All prices are in pounds sterling and are quoted per person unless stated otherwise. Prices are subject to availability and may change until your booking is confirmed; once confirmed, your price is fixed except for changes required by law (such as changes in taxes or fuel surcharges). A deposit is due at the time of booking, with the balance payable no later than 12 weeks before departure (or as stated in your confirmation). If you book within 12 weeks of departure, full payment is due at the time of booking. We will notify you of your balance due date in writing. Non-payment of the balance by the due date may result in cancellation of your booking and cancellation charges.
5. Financial protection
When you buy a package holiday from us that includes a flight, it is protected under the ATOL scheme. You will receive an ATOL Certificate when your booking is confirmed; the flights and package listed on it are financially protected. Please ask us for our ATOL number [ATOL NUMBER] before booking, and check your Certificate carefully. Bookings that do not include a flight are protected through our trust account and insurance arrangements — details available on request.
6. Amendments by you
If you wish to change your booking after confirmation, we will do our best to help, subject to availability and to any charges imposed by our suppliers, plus a reasonable administration fee. A change of the lead name or destination may be treated as a cancellation and rebooking.
7. Cancellation by you
If you cancel, cancellation charges apply on a scale that increases as the departure date approaches, as set out in your booking confirmation (typically: loss of deposit, then a rising percentage of the total price). We recommend you take out comprehensive travel insurance at the time of booking, including cancellation cover, so you are protected if you have to cancel for an insured reason.
8. Changes or cancellation by us
We plan carefully and changes are rare. If we must make a significant change to your booking, we will tell you as soon as possible and offer you the choice of accepting the change, an alternative holiday of comparable or better standard, or a full refund, in line with your rights under the Package Travel and Linked Travel Arrangements Regulations 2018.
9. Passports, visas and health
It is your responsibility to ensure you and everyone on your booking hold a valid passport (with sufficient validity for your destination), any required visas, and any recommended vaccinations. We provide general guidance on our website, but entry requirements change — please confirm with the relevant embassy or authority before travel. We are not liable for refusal of carriage or entry where these requirements are not met, or for costs arising from them.
10. Travel insurance
Comprehensive travel insurance is strongly recommended and, for some trips, required. It is your responsibility to arrange cover that is appropriate for your needs, including medical, cancellation and baggage cover. We can point you to suitable providers but do not act as an insurance intermediary.
11. Your responsibilities
You must behave in a way that does not disrupt other travellers, damage property or break local law, and you are responsible for any loss or damage you cause. Special requests should be made in writing at booking; we will pass them on to suppliers but cannot guarantee them. If you have a disability or reduced mobility, please tell us before booking so we can confirm the trip is suitable and that your needs can be met.
12. Liability
We accept responsibility for the proper performance of our contractual obligations, subject to applicable law including the Package Travel and Linked Travel Arrangements Regulations 2018. Our liability may be limited where the law permits — for example, for loss or damage caused by events beyond our control (force majeure), or where international conventions limit the liability of carriers and hotels. Nothing in these terms excludes liability for death or personal injury caused by our negligence or for fraud.
13. Events beyond our control
We are not liable where performance is prevented or affected by circumstances beyond our control that we could not reasonably have foreseen or avoided, including natural disaster, epidemic or pandemic, civil unrest, industrial action, or acts of government.
14. Complaints
If something goes wrong, please tell our local representative or contact us as soon as possible so we can put it right. If the matter cannot be resolved during your trip, write to us at [CONTACT EMAIL] within 28 days of your return and we will investigate promptly. Where a dispute remains unresolved, you may be able to refer it to an alternative dispute resolution scheme approved for travel (details on request).
15. Data protection
Any personal data you provide will be handled in accordance with our Privacy Policy.
16. Governing law
These terms are governed by the law of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
